دسترسی آژانس به مراکز نظامی از منظر حقوق بین‏ الملل (با تأکید بر برجام)

چکیده

هدف این مقاله بررسی مقررات موافقت‏نامه پادمان جامع، پروتکل الحاقی و برجام در خصوص دسترسی آژانس به مراکز نظامی و شرایط و محدودیت‏های آن است. در معاهده منع گسترش سلاح‏های هسته‏ای و موافقت‏نامه‏های پادمان جامع مرتبط با آن، صلاحیت یا اختیاری برای آژانس بین‏المللی انرژی اتمی مبنی بر دسترسی به مکان‏های نظامی کشورهای متعاهد وجود ندارد. پروتکل الحاقی نیز مقررات صریحی مبنی بر دسترسی آژانس به مراکز نظامی پیش‏بینی نکرده است. در سند برنامه جامع اقدام مشترک (برجام) هم با وجود اینکه سازوکار پیچیده‏تر و شفاف‏تری در نظر گرفته شده، اما هیچ‏گونه حق یا صلاحیتی برای آژانس در این مورد در نظر گرفته نشده و هرگونه دسترسی در این مورد مشروط به رضایت و همکاری داوطلبانه ایران است.

چکیده [English]

The paper illustrates the provisions of the Comprehensive Safeguard Agreement, Additional Protocol and JCPOA, in terms of the inspectors’ access to military sites and the restrictions thereof. The NPT and the comprehensive safeguard agreements have not envisaged any discretionary power for the IAEA regarding the access to military sites of the States Parties. Neither the Addition Protocol has foreseen such a right. JCPOA has a sophisticated and clear provisions but not a right to access to military sites and any such an access is subject to consent and voluntary cooperation of Iran.
