پیوند تنگاتنگ قوانین کیفری با امنیت ملی برای پیکار با اقدامهای تروریستی، چهره مرکبی از حقوق کیفری پدید آورده که به واسطه آن، هرچند این قانونها و به ویژه، مقررات شکلی آن افزاری برای بازداشتن دستاندازی دولتها به حقوق و آزادیهای فردی به شمار میآید، ولی در همان حال، وسیلهای است برای قدرت تا اقدامات سختگیرانه و تدابیر محدودکننده به نفع امنیت ملی را مشروعیت بخشد.قوانین ضد تروریسم به بهانه اینکه تروریستها، مجرمین خطرناک، سازمانیافته، متعصب و غیر قابل اصلاح هستند و غالباً مورد حمایت مادی و معنوی مردم یا دولتها قرار میگیرند، آیین دادرسی سخت و محدودکنندهای به کار گرفتهاند که نه تنها مظنونان تروریستی را دربرگرفته، بلکه نشانههای آن بر حقوق و آزادیهای شهروندان نیز بروز کرده است.
The close relationship between the criminal law and national security in fight against terrorism has produced a mixed picture of criminal law by which although the relevant regulations are preventing governments from interfering in individual rights and freedoms, however they provide a pretext for justification of their authoritative and limitative actions in favor of national security.In this way, due to some characteristics of terrorist groups like dangerousness, organization, biasness and un-modifiability, anti– terrorist laws consist of some tough regulations regarding terrorists which are finally affecting freedom and rights of the ordinary citizens
