In the Islamic Republic’s Constitution, three categories of ethnic group, religious minority and denominational minority have been distinguished, and while the religious minority may be combined with the two other groups, separate rights have been provided for each of them which themselves can be amalgamated.   Undoubtedly, the rights of minorities are discussed when there is kind of difference, and most of Iranians and the religious government arising from the Constitution are largely different from the religious minorities. Hence, the designers of the Constitution have paid much attention to the religious minorities whereas the mere ethnic minorities have not been subject to much attention.   Apart from the seats reserved for the religious minorities in the Islamic Consultative Assembly, there is a one-article act providing for the respect for their religious rights and performance of their religious rituals. However, religious and ethnic minorities, due to their commonalties in religion, have been regarded as part of the majority Iranian society in terms of social and political rights. Therefore, in cultural domain, their rights for continuing their cultural existence have been sanctioned and the freedom of religious rituals for the Muslim denominational minorities has been respected according to the act in question.}, keywords = {Minorities,Ethnic Groups,Basic Rights,Islamic Republic’s Constitution}, title_fa = {اقلیت‌ها در قانون اساسی جمهوری اسلامی ایران}, abstract_fa = {مطالعه حقوق اقلیت‌ها و گروه‌های قومی در قانون اساسی جمهوری اسلامی ایران، نشانگر آن است که علیرغم فقدان الگوی مشخص و منسجم و عدم استفاده از مدل‌های رایج جلب و تأیید مشارکت اقلیت‌ها در این سند حقوقی، حقوق گروه‌های مذکور به طرق گوناگونی مطرح شده و محفوظ مانده است. در قانون اساسی کشورمان، سه مقولة گروه قومی، اقلیت دینی و اقلیت مذهبی از یکدیگر تفکیک شده و در حالی که اقلیت قومی با دو گروه دیگر قابل جمع است؛ برای هر یک به طور جداگانه حقوقی مطرح شده که با هم جمع پذیرند.   روشن است که حقوق اقلیت در جایی مطرح می‌شود که تفاوت وجود داشته باشد و اکثریت ایرانیان و حکومت دینی برخاسته از قانون اساسی نیز بیشترین تفاوت را با اقلیت‌های دینی دارند. بنابراین، تدوین کنندگان قانون اساسی جمهوری اسلامی ایران نیز بیشترین عنایت را به اقلیت‌های دینی معطوف کرده و اقلیت‌های قومی صرف را کمتر مورد توجه قرار داده‌اند.   برای اقلیت‌های دینی، غیر از کرسی‌های تضمین شده در مجلس شورای اسلامی، ماده واحده‌ای نیز برای رعایت حقوق مذهبی و اجرای شرایع دینی‌شان وجود دارد. اما اقلیت‌های مذهبی و قومی، به واسطة اشتراک در دین، به لحاظ حقوق اجتماعی و سیاسی، بخشی از اکثریت جامعة ایرانی به حساب آمده‌اند. بنابراین در ساحت فرهنگی کشور، حق آنان برای تداوم بخشی به هستی فرهنگی‌شان تأیید و آزادی شعایر مذهبی اقلیت‌های مذهبی مسلمان، با عنایت به ماده واحدة مذکور، تأمین شده است.}, keywords_fa = {اقلیت‌ها,گروه‌های قومی,حقوق اساسی,شهروندی,دین}, url = {https://quarterly.risstudies.org/article_1037.html}, eprint = {https://quarterly.risstudies.org/article_1037_9a07dea376345a83f263e2b72d355a59.pdf} }
