The connection between them protects national<br />security in a way that not only special authorities or institutions but also everyone is<br />considered as the guardians of national security. When propounding expediency as a<br />strong principle in introducing national security in Iran, this field moves away from<br />the main principle that is based on public presence and finds a fragile position. Apart<br />from this, Iran's national security, with its internal and external security approach,<br />continues to be practically within the legal system rather than along it. The proposal<br />of this article is to legalize national security according to the Constitution, as well as<br />to focus on moral and religious principles and to adopt an exceptional approach to<br />the basis of expediency. Thus, national security will gain a well-established place in<br />the legal system. این مقاله با روش تحلیلی به خاستگاه ‏های حقوقی امنیت ملی در جمهوری اسلامی ایران پرداخته و با بررسی پیوند امنیت ملی و نظام حقوقی، جایگاه امنیت ملی در نظام حقوقی و مسیر پیش روی نظام حقوقی امنیت ملی، به این نتیجه رسیده است که مبنای اصلی امنیت ملی در ایران بر پایه قانون اساسی، تکلیف‏ های همگانی و حقوق و آزادی‏های افراد است. پیوستگی این دو، سبب پاسداشت امنیت ملی می‏شود؛ به‏ گونه ‏ای که پاسدار امنیت ملی در ایران نه مقام‏ها یا نهادهای خاص، بلکه همگان‏ اند. اما با پیش کشیدن مصلحت به ‏عنوان مبنای نیرومند در معرفی امنیت ملی در ایران، این حوزه از مبانی اصلی که مبتنی بر حضور همگانی است، دور شده و جایگاه شکننده ‏ای یافته است. جدا از این، امنیت ملی ایران با رویکرد امنیت درون‏ سرزمینی و برون ‏سرزمینی، همچنان در عمل در عرض نظام حقوقی جای می‏ گیرد تا در طول آن. پیشنهاد این مقاله، حقوقی‏ سازی امنیت ملی بر اساس قانون اساسی و نیز محوریت بخشیدن به مبانی اخلاقی و شرعی و اتخاذ رویکرد استثناگرا نسبت به مبنای مصلحت است؛ تا از این در، امنیت ملی جایگاه تثبیت‏ شده در نظام حقوقی یاید. https://quarterly.risstudies.org/article_130715_69842973093ba673322fecaba4f9c0ce.pdf
