In order to achieve successful record, those international treaties require a proper bed at which all member states should delineate their borders and join those treaties; but this is not the case at present. Marine safeguarding measures are of those quick responses to coupe the threats and dangers that sometimes push a given party to comply with the relevant obligations. These measures can be discussed either through legal or a military view. Marine safeguarding measures include actions established according to the law and is implemented on responsible authorities, ships, passengers and commodities that lack a criminal nature and they are done just to coupe a threat or make compliance with the relevant obligations in the area of territorial sea.  ترابری دریایی هنوز در زیر سایه پیمان‌های بین‌المللی، موافقت‌نامه‌های دوجانبه و حتی قوانین ملی، احساس امنیت نمی‌کند. پیمان‌های جهانی و بین‌المللی نیاز به بستری دارد که همه کشورهای دارای مرز دریایی و حتی دیگر کشورها به آن‌ها پیوسته و مفادش را به اجرا بگذارند که چنین بستری فراهم نیست. اقدام تأمینی دریایی به تدابیر باشتاب برای دفع تهدید یا خطر و گاه برای ایجاد التزام عملی برای طرف دیگر گفته می‌شود. این اقدام می‌تواند از دو جایگاه حقوقی و نظامی بررسی شود. جایگاه حقوقی اقدام تأمینی به اعمال موردهای پیش‌بینی‌شده در قانون در قبال متصدیان ترابری دریایی، کشتی‌ها، کالا و مسافر گفته می‌شود که طبیعت کیفری و ماهیت جبران زیان نداشته و تنها برای دفع خطر یا ایجاد التزام و به طور ویژه در گستره دریایی مربوط به حاکمیت سرزمینی انجام می‌شود. https://quarterly.risstudies.org/article_13094_f96e42572185f05478d84f901007f164.pdf
